These Terms of Service ("Terms") govern your use of services provided by The Real McCoy Photography ("we," "us," or "our"). By booking a photography session or using our services, you agree to these Terms.

1. Services Provided

The Real McCoy Photography offers professional photography services including:

  • Portrait photography

  • Headshot photography

  • Family photography

  • Maternity photography

  • Couples photography

  • Grads & Senior photography

  • Conference headshot booth services

Services are provided based on the package or session type you book.

2. Booking and Payment

Booking: Photography sessions must be booked in advance. Booking confirmation and reminders are sent via email or text message (if you've opted in to SMS).

Payment: Payment terms are outlined in your booking confirmation or contract. We accept payment via the methods specified during booking.

Retainers: Some services may require a retainer to secure your session date. Retainer amounts and refund policies are specified at the time of booking.

3. Session Details

Scheduling: Session date, time, and location are confirmed during the booking process. If you need to reschedule, contact us as soon as possible.

Cancellations: Cancellation policies vary by service type and are provided at the time of booking. Late cancellations or no-shows may result in forfeiture of retainers.

Weather and Unforeseen Circumstances: For outdoor sessions, if weather or other unforeseen circumstances require rescheduling, we will work with you to find an alternative date at no additional charge.

4. Photo Delivery and Usage Rights

Delivery: Edited photos are delivered via private online gallery within the timeframe specified in your booking agreement).

Usage Rights: You receive personal usage rights to your photos for personal, non-commercial use. This includes printing, sharing on social media, and displaying in your home or office.

Commercial Use: Commercial use of photos requires written permission and may involve additional licensing fees.

Our Portfolio Rights: By booking with us, you grant The Real McCoy Photography permission to use photos from your session for marketing, portfolio, social media, and promotional purposes unless you specifically opt out in writing or specify during the booking process.

5. Copyright

All photographs remain the intellectual property and copyright of The Real McCoy Photography. You may not sell, redistribute, or claim ownership of the images.

6. Model Release

By participating in a photography session, you grant permission for The Real McCoy Photography to photograph you and use those images as described in Section 4 above.

For sessions involving minors, the parent or legal guardian grants this permission on behalf of the minor.

If you do not wish to grant model release rights, you can mark your gallery as private after purchase.

7. Text Messaging Terms

If you opt in to receive text messages:

  • You may receive booking confirmations, session reminders, and updates

  • Message frequency varies

  • Message and data rates may apply

  • You can opt out anytime by replying STOP

8. Liability

Our Responsibility: We take reasonable care to provide professional photography services. However, we are not liable for circumstances beyond our control, including equipment failure, acts of nature, or venue/location restrictions.

Your Responsibility: You are responsible for arriving on time to your booked session and following any instructions provided.

Backup and Data Loss: While we maintain backup systems, we are not liable for catastrophic data loss due to circumstances beyond our control.

9. Conduct and Respect

We are committed to providing an inclusive, respectful environment for all clients. We serve clients of all backgrounds, cultures, ethnicities, neurodiversities, and sexualities.

We expect clients to treat our team with respect. We reserve the right to refuse service or terminate a session if behavior is abusive, threatening, or disrespectful.

10. Privacy

Your personal information is handled according to our Privacy Policy. We do not sell or share your personal information for marketing purposes.

11. Changes to Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised "Last updated" date.

Continued use of our services after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Arizona, United States.
